Stop PCHETA: The Senate’s dangerous palliative care bill

Right now, the U.S. Senate is acting on a bill that would expand and promote palliative care without the reforms that are needed to improve care and protect patients from the assisted suicide and euthanasia agendas. We have a chance to stop this bill, but we must act now. Senators are voting this Thursday, December 12th!

UPDATE 12/12/19: The Palliative Care and Hospice Education and Training Act (PCHETA) was stopped in committee! The US Senate HELP Committee has removed the bill from its agenda, announcing it would not be voted on today due to “last minute concerns.” The bill will remain in committee. Thank you for taking action to stop this dangerous bill! You truly made a difference! We will stay vigilant in case attempts are made to bring it to a vote in this committee in 2020.

The Palliative Care and Hospice Education and Training Act (PCHETA) (S. 2080 and its companion H.R. 647) seeks to expand palliative care by funding more permanent palliative care faculty. It promotes related education and research and creates a public awareness option for “selling” palliative care to patients and their physicians.

Palliative care has become dangerous and deadly in many places. Too many people are abused or “helped” to die, instead of being helped to live well in the time they have left. By the time a patient’s family realizes what’s going on, it’s often too late.

Palliative care should be reformed before it is expanded and promoted by the federal government through PCHETA.

Steps you can take right now to stop this bill from moving forward are at the end of this article. Please take action now.
The history and aims of palliative care

Palliative care grew out of and includes hospice. It offers an earlier pathway to hospice care and provides assessment and treatment of pain and other problems—physical, psychosocial, and spiritual. Physicians who are board certified in palliative care are also board certified in hospice.

The two are always linked.

The George Soros’ Open Society Institute and the Robert Wood Johnson Foundation have spent more than $200 million to develop and expand palliative care as their mechanism for changing how we die in America. The organizations they created, such as the Center to Advance Palliative Care and the American Academy of Hospice and Palliative Medicine, continue to influence palliative care.

After decades of promoting hospice and palliative care as the best way to die, leaders in the field realized “families facing a serious illness do not want a good death; they want a cure.”  So, they separated their promotion of palliative care from hospice to reach more patients “upstream.” Still, palliative care remains oriented toward death.

Hospices are already using palliative care as a “loss leader” to enroll more patients in hospice earlier. A loss leader is a service sold below cost to attract more customers, who will then buy more profitable services. (Under Medicare rules, those who enroll in hospice must be terminal with death predicted in 6 months or less and give up curative medical care.) These prematurely enrolled people are more profitable because they need less care. The HHS Office of Inspector General reported people were inadequately informed their care had switched to hospice and sometimes were placed in hospice completely without their knowledge.

Aspire Health, the largest community-based palliative care company in the U.S., began with $50 million in venture capital, including $30 million from Google. Aspire Health claims to have an algorithm that can pinpoint when people will die. Anthem, a health insurer, now owns Aspire Health, which contracts with Medicare Advantage plans.

Palliative care has become more deadly and dangerous

As a practicing attorney who advocates for the elderly, infirm, and disabled, I have seen many cases where people with years to live were tricked into palliative care, which went on auto-pilot with strong drugs leading to death. The following story serves as a sobering example:

A widow in northwest Wisconsin became forgetful. She moved into an assisted living facility where her children thought she would be safer. The staff soon complained about her constant shouting and said they needed more help. So her family agreed to hospice for the extra help—not because she was terminal. Ten days later she was dead after being drugged to unconsciousness. Before that, she was walking and talking and knew who she was and who other people were. She could carry on a conversation. So why all that shouting? The staff had lost her hearing aids.

Here are a few more examples:

In their opposition to PCHETA, the National Association of Pro-Life Nurses said their members are seeing unethical practices, such as terminal sedation (with withdrawal/withholding of food, water, and critical medicines) and voluntary stopping of eating, drinking, and even spoon feeding, etc., now being called palliative, “comfort,” or “routine” hospice care.

These practices are so prevalent, they were:

Dr. Farr Curlin, a palliative medicine specialist at Duke University, describes the situation this way:

“Many patients and their families don’t trust HPM [Hospice and Palliative Medicine] and are resistant to it. I encounter such individuals in the hospital and in the community, among people of all walks of life and social strata, but particularly among ethnic minorities and members of religious communities. These individuals tell stories about loved ones who declined slowly over time, fighting the good fight with the support and companionship of their family members and friends. When HPM professionals became involved in their care, their loved ones were put on powerful drugs, became unconscious and unresponsive, and were soon dead. These stories are clearly shared within communities and powerfully shape people’s perceptions of HPM, which many see as a sophisticated and seductive way of getting people to die.”

Palliative care is used as a rationing tool

Palliative care is being used to create a second tier of health care that smacks of rationing. For example, as previously mentioned, Aspire Health (a for-profit business) created an algorithm that mines insurers’ data about patients without their knowledge to predict when patients will die. After they talk to the patients’ primary care physicians, they decide who to target. How it works is summarized below, based on explanations in articles here, here, and here:

  • Rather than rely on referrals, Aspire contacts patients directly and 85% sign up.
  • Patients are offered physicians and nurses who make house calls. “Palliative” is not mentioned, nor is “life expectancy.” Patients are not told Aspire’s goal is to reduce costs by offsetting treatment against life expectancies.
  • Aspire sends a team into the home, spending time to build trust. Next, they discuss the time the patient has left and guide the patient through difficult treatment choices.
  • A key part of the program is discussing what treatments they should refuse. The idea is to prevent patients who only have a short while to live from undergoing unpleasant and unnecessary treatments.

Aspire claims to save thousands per patient by reducing hospitalizations for its Medicare Advantage plan clients. But, MedPAC found spending on Medicare Advantage plans is 2% to 5.5% higher, not lower, than traditional Medicare.

Dr. Cinthia Briseño, founder of Frisk Innovations for Patient-Centered Care, raises the following questions:

  • Does the death predicting algorithm identify people too early, so as to bolster Aspire’s profits, thereby leading patients to abandon curative treatment too soon?
  • Does the algorithm accurately predict when people will die?
  • Is peoples’ privacy being invaded?
  • What treatments does Aspire consider unnecessary?
  • Is access to care improved?
  • What are the actual cost savings?
The PCHETA bill expands the status quo

The PCHETA bill expands the reach of palliative care as it is now practiced. It does not require changes or improvements. The word “improve” appears once, only in relation to training by education centers that would be created in response to the legislation (Sec. 759A(a)(2) in the bill).

The bill provides a loophole. No improvements are required of existing training centers, which are entitled to the same funding (Sec. 759A(a)(3) in  the bill.) The Soros-backed Center to Advance Palliative Care has created nine regional training centers that qualify for this funding.

Nothing in the PCHETA bill would improve the delivery of palliative care or prevent abuses.

Nothing in the PCHETA bill helps patients avoid and escape dangerous palliative care.

The Health and Human Services Office of Inspector General has issued three scathing reports about hospice fraud and abuses. You can read those reports here, here, and here. The bill does not incorporate the Inspector General’s recommended changes to federal laws to address hospice fraud and abuse.

The PCHETA expands the reach of dangerous and abusive palliative care.

PCHETA’s Section 5 clarifications are meaningless

Supporters of the PCHETA, some of whom are staunch opponents of assisted suicide and euthanasia, point out that Section 5 of the bill contains two protections against the dangers of palliative care. These protections were added at the request of the US Conference of Catholic Bishops (USCCB), in exchange for their public support. Section 5(a) reads:

Clarification: None of the funds made available under this Act (or an amendment made by this Act) may be used to provide, promote, or provide training with regard to any item or service for which Federal funding is unavailable under [the Assisted Suicide Funding Restriction Act]. (emphasis added)

The Assisted Suicide Funding Restriction Act (ASFRA) is supposed to prevent federal funds from being used to assist in a patient’s suicide, euthanasia, or mercy killing, with several exceptions; to pay for services that intentionally cause death by these methods; or to pay for health plans that include coverage for those services.

PCHETA’s clarification is much narrower. It only applies to funds provided by PCHETA, not all federal health care dollars. It does not prevent dangerous palliative care; it only seems to stop funding, based on ASFRA’s language. Nothing prevents the palliative care industry from using other funds to promote assisted suicide and euthanasia as a societal good. Also, nothing prohibits the addition of separately funded educational courses in dangerous and deadly practices.

PCHETA is expected to fund 50 academic physician-leaders who, in turn, will teach about 9,300 additional health care professionals. The PCHETA clarifications do not apply to the 9,300 at all—those who will become the clinicians who care for us patients.

Acknowledging the above criticism, the USCCB requested that the Senate add a second protection, at Section 5(b). It reads:

Additional Clarification: As used in this Act (or an amendment made by this Act), palliative care and hospice shall not be furnished for the purpose of causing, or the purpose of assisting in causing, a patient’s death, for any reason.

This provision applies to the furnishing of palliative and hospice care, but only under the PCHETA Act, which provides for education, training, and research, not the furnishing of care. The actual furnishing of care will occur after providers are trained, but that furnishing will not be funded by PCHETA.

Unfortunately, the USCCB and the Catholic Medical Association now publicly support the PCHETA.

What you can do right now to stop PCHETA

Euthanasia Prevention Coalition USA is organizing a grassroots contact with key senators to stop the PCHETA. Both versions of the bill (S.2080 and H.R. 647) are currently in the Senate Health, Education, Labor and Pensions (HELP) Committee, which is set to vote to move S.2080 out of committee on Thursday, December 12th. It is critical that you voice your opposition now.

Revelations stated that the {PALE HORSE} would enter into existence in these “LAST DAYS” and the “PALE HORSE” is the one of “DEATH”. This is just the beginning of “DEATH” that’s going to grip our world and all you need to do is look around you everywhere and you can see the stage being set where there’s going to be clashes everywhere that will bring about {DEATH AND DESTRUCTION EVERYWHERE}. We are there and just watch the escalation of death everywhere. One thing to watch for and I believe real soon is the {TOTAL ANNIHILATION OF MYSTERY BABYLON} which is the United States. Once that happens, the world’s most powerful and populated “DRUG PRODUCTION MANUFACTURERS” will be wiped out along with it. This will cost multi millions of people {FOR EXAMPLE} that are suffering with AIDS/HIV to be dead in a few short months because the concoction of drugs they use to hold of their disease from becoming “FULL BLOWN” will be gone. {CANCER PATIENTS} gone in a short time because treatments are gone, TB drugs all wiped out so the spread of Tuberculous will run rapid as will Ebola and many other diseases that are held at bay right now.   22. IF the idea of “palliative care” were to be truly carried out, then it would be a great way for US to make death, the only “sure thing” less or even NOT frightening. But the bridge between “palliative care” and EUTHANASIA and ABORTION is getting shorter and shorter. IF “palliative care” were to EXCLUDE active ending of life, then GREAT! Just because one does not BELIEVE there is “a hereafter” and GOD, doesn’t mean these don’t exist! The mind lives on. The “identity” lives on, also. Our “spirit” is immortal.   24. Thank you for leading the charge on this & for alerting us to this bill. As a busy, homeschool mom, I’d never know about it otherwise.
    I strongly believe my elderly uncle died, not from the cancer with which he was diagnosed, but from being starved/dehydrated to death because the drugs they gave him lulled him into a state of unconsciousness that prevented him from being able to eat or drink. Because they deemed him “terminal,” he was not given an IV of fluids, either. I could cry just thinking about the last week and half of his life. He went being able to talk/hold a conversation, eating steak & potatoes. Just a few days later, I was told he wasn’t eating or talking. Sadly, even though I was his niece, I had no say in what was happening to him. I find this to be murder under the guise of “comfort care.” But because those in charge of his life, convinced him to get cremated, there is no way of proving this. Breaks my heart.

    When both my parents were dying, the palliative care staff pushed their opinions on our family–to the point we had to ask them to leave the room.

    • Just went through advocating for my sisters health care. Not enough time for all the details.. all i can say is she recovered from a very bad reaction to a chemo treatment because we stedy by her side for at least 12 hrs a day , kept her alive by being proactive and insisting on the least amount of medicine. We . As a family, collectively worked with her care team and kept her alive. Then once out of icu, she went to a cancer care ward, and there they started her on morphine, to shut her up.. she was scared and alone at night. They wanted to put her as hospice , and we refused. We insisted she not be given morphine , instead they put an aid at her door, and the family, when possible stayed in a chair over night in her room. She was in the hospital about 24 days,
      When we saw she was not getting any services,we all said let’s get her out of here.. we found a highly rated privately owned rehab who accepted medicare.
      30 days later after so much love, food support and therapies from the rehab and hard work on my sisters part. She is home. We are looking for alternate medicine to treat the lung cancer, but for now she is back to normal eating walking, toileting, laughing and
      Enjoying life . Truely a miricle, but would have lost her if we were not one step ahead of the hospital… all those giving her care in icu and step up were awesome, but once sent to the cancer floor, it was clear they weren’t going to do anything to further her recovery.

  33. We have been given the right to life by God. No one has that right to end a life. All Democrats who would think of approving such a bill will have to answer to their God in whatever faith they claim to practice. All who claim they are Catholic are definitely not. Int the end they will be the greatest losers.

    • Unfortunately, the PCHETA is a Republican-sponsored bill. The pro-life movement has a long way to go to educate our representatives on the right to life, from conception to natural death. Thanks for your comment.

  34. My friend’s children ended her life so they could inherit her money faster. It is legal. It is appalling. It should only happen to those who think this murder is a good idea.
